What happened

Landlord applied for an order to terminate the tenancy and evict the Tenant because the Tenant, another occupant of the rental unit or a person the Tenant permitted in the residential complex has seriously impaired the safety of any person and the act or omission occurred in the residential complex. The Landlord submitted surveillance video and police report showing the Tenant stabbing an acquaintance in the rental unit, and the Tenant was charged with aggravated assault.

The ruling

The Landlord's application is granted, but the Tenant is granted conditional relief from eviction. The Tenant must not engage in any behaviour that seriously impairs the safety of any tenants, Landlord's agents, or guests in the residential complex for 12 months. If the Tenant fails to comply, the Landlord may apply for an order terminating the tenancy and evicting the Tenant. The Tenant must also pay the Landlord $1,559.41 in compensation and $186.00 in application fees.
