What happened

The Landlord applied for an order to terminate the tenancy and evict the Tenant due to non-payment of rent. The Tenant requested an adjournment to resolve issues with their rent subsidy and confirm arrears, but the request was denied as the LTB does not have jurisdiction over subsidized housing rent determinations. The Board found the Landlord served a valid N4 notice and the Tenant failed to void it. The eviction was postponed to allow the Tenant time to either resolve the subsidy issue to pay the arrears or find alternative housing.

The ruling

The tenancy is terminated unless the Tenant pays $6,258.00 by November 30, 2025 (or higher amounts by later dates) to void the order. If the order is not voided, the Tenant must vacate by January 6, 2026, and pay the Landlord $4,859.31 plus daily compensation of $35.11 until they move out. The eviction was postponed to January 2026 to allow the Tenant time to address their rent subsidy issues.
