What happened
The Applicant filed an application claiming the Landlord entered the rental unit illegally. The Landlord's representative moved to dismiss the application, arguing that the Applicant had already been determined by the Board in a previous case (LTB-T-072870-23) not to be a lawful tenant. The Board applied the doctrine of issue estoppel, concluding that since the Applicant's status as a non-tenant had been finalized and not successfully appealed, she lacked the legal standing to file an application under the Act.
The ruling
The application was dismissed because the Applicant was not a lawful tenant of the rental unit. The Board ruled that a previous decision identifying the Applicant as a non-tenant was final, and the principle of issue estoppel prevented the matter from being re-heard.
