What happened

The Landlord applied to terminate the tenancy because the Tenant breached a payment condition from a previous LTB order. An ex-parte eviction order was issued. The Tenant then filed a motion to set aside that eviction order. At the hearing for the motion, both parties consented to a new agreement. This order grants the Tenant's motion, cancels the prior orders, and establishes a new payment plan for the Tenant to pay substantial arrears.

The ruling

The Tenant's motion to set aside a prior eviction order is granted. By consent, the previous orders are cancelled. The Tenant is ordered to pay the Landlord total arrears and costs of $15,726.36 via a specific payment plan, in addition to paying ongoing rent. If the Tenant fails to make any payment, the Landlord can apply to the LTB for an eviction order without further notice.
