What happened
The Landlord applied to evict the Tenants for non-payment of rent. The Tenants contested the lawful rent amount and claimed they withheld rent due to unresolved maintenance issues, including a fridge, dryer, dishwasher, and resulting mold. The Board found the lawful rent was $3,750.00 per month, as the Tenants had paid this amount for over 20 months, deeming the increase valid under the Act. The Board ruled that withholding rent is not permitted and found the Tenants' evidence of a serious, ongoing breach by the Landlord insufficient to deny eviction.
The ruling
The tenancy is terminated unless the Tenants void the order by paying the arrears. The Tenants can pay $33,092.01 by June 30, 2025, or $36,842.01 by July 31, 2025, to continue the tenancy. If they fail to do so, they must vacate by July 31, 2025, and owe the Landlord $25,355.59, plus daily compensation of $123.29 from May 27, 2025. The eviction was delayed to give the Tenants time to find new housing.
