What happened
The Landlord applied for an order to terminate the tenancy and evict the Tenants due to significant rent arrears exceeding $40,000.00. The Tenants attempted to argue that one tenant had vacated and the joint tenancy was severed via an N11 agreement; however, the Landlord contended the signature on the N11 was forged, as the property manager who allegedly signed it had passed away. Furthermore, the Tenants failed to comply with a previous interim order to pay $500.00 per month toward ongoing rent.
The ruling
The tenancy is terminated effective September 20, 2025. The Tenants are ordered to pay the Landlord $34,774.46 to account for arrears up to the hearing date, minus the rent deposit and interest. To void the eviction and continue the tenancy, the Tenants must pay $40,686.00 by September 14, 2025, or $45,186.00 by September 20, 2025. The Landlord is authorized to file with the Sheriff for eviction starting September 21, 2025.
