What happened

The landlord applied to terminate the tenancy and evict the tenant due to the tenant seriously impairing the safety of others and wilfully causing undue damage to the rental unit and residential complex. The landlord alleged the tenant threw dangerous items from his balcony, caused damage to the rental unit, and engaged in aggressive and argumentative behavior.

The ruling

The tenancy is terminated effective April 30, 2023. The tenant must vacate the unit by this date or the landlord can file the order with the Sheriff for enforcement. The tenant must pay the landlord $996.92 for use of the unit from January 20 to March 20, 2023, less the rent deposit and interest owed, as well as $33.70 per day from March 21, 2023 until the tenant vacates. The tenant must also pay the $186 application fee.
