What happened
The Landlord applied to terminate the tenancy and evict the Tenant due to non-payment of rent. The Tenant attempted to raise maintenance or conduct issues under section 82 of the Act during the hearing. However, the Board refused to hear these issues because the Tenant failed to comply with disclosure requirements, specifically failing to serve a list of issues and evidence on the Landlord five days prior to the hearing. The Tenant had already vacated the rental unit by November 8, 2025, before the hearing took place.
The ruling
The tenancy was terminated effective November 8, 2025, the date the Tenant vacated the property. The Tenant is ordered to pay the Landlord $3,179.14, which covers rent arrears up to the move-out date and the application filing fee, adjusted for a $200.00 payment made after the application was filed. The Tenant's request to address Landlord conduct was denied due to lack of disclosure.
