What happened

Landlord applied for an order to terminate the tenancy and evict the Tenant due to persistent late payment of rent. The Tenant was properly served with notice of the hearing but did not attend.

The ruling

The Tenant has persistently failed to pay rent on time, which is the basis for an N8 notice under the Act. The Tenant did not attend the hearing or provide any justification for the late payments. The Landlord is entitled to terminate the tenancy and the Tenant must vacate the unit by September 24, 2024. The Tenant owes the Landlord $1,680.94, which includes compensation for use of the unit, filing fees, and the rent deposit and interest, minus the amount owed to the Tenant for the rent deposit interest.
