What happened
The Landlord applied to terminate the tenancy for personal use (N12 notice). At the hearing, the Tenant's representative raised a preliminary issue regarding the validity of the notice of termination. The representative argued that the notice was defective because it only named one tenant, while there were two legal tenants residing in the unit. The Landlord admitted he was aware the second individual lived there but claimed he followed information from the previous owner.
The ruling
The Landlord's application to terminate the tenancy for personal use is dismissed. The N12 notice was found to be legally defective because it failed to include the names of all tenants of the rental unit. As the notice was invalid, the Landlord cannot proceed with the eviction process under this application.
