What happened

The Tenant applied for an order determining that the Landlords gave a notice of termination in bad faith. The Landlords sent a letter instead of a formal N12 form, stating they needed to move into the unit because they could no longer afford mortgage payments. However, prior to this, the Landlords had requested a significant rent increase. After the Tenant vacated, the unit was listed for rent on MLS within a month.

The ruling

The Landlords are ordered to pay the Tenant a total of $9,534.59. This includes one month's rent as statutory compensation ($1,801.36), a rent differential for one year ($5,449.32), moving expenses ($363.91), general compensation for increased commute costs ($1,872.00), and the application filing fee ($48.00). The Landlords did not attend the hearing to contest the allegations of bad faith.
