What happened

The Tenant filed two applications (T1 and T6) against the Landlord. The T1 application alleged that the Landlord collected or retained money illegally. The T6 application alleged that the Landlord failed to meet maintenance obligations or comply with health and safety standards. During the hearing, the parties reached a settlement and consented to an order that terminates the tenancy and requires the Landlord to pay a significant monetary sum to the Tenant.

The ruling

By consent, the Landlord is ordered to pay the Tenant $36,100.00 to resolve illegal money retention and maintenance issues. The tenancy will end on September 15, 2025. If the Tenant vacates and returns the keys by this date, the Landlord must pay the full amount on the move-out day. Failure to pay will result in 4.00% annual interest. If the Tenant fails to vacate, the Landlord may seek eviction enforcement through the Sheriff on September 16, 2025.
