What happened
The Landlord applied to terminate the tenancy and evict the Tenant due to significant rent arrears. The Tenant, a 65-year-old senior, has resided in the unit since 2015 but experienced financial hardship as his current income from CPP benefits is insufficient to cover the monthly rent. The Landlord requested eviction, while the Tenant requested a payment plan.
The ruling
The tenancy is terminated effective January 31, 2026. The Tenant is ordered to pay $6,898.46 to the Landlord for arrears and filing costs, after deducting the rent deposit and interest. The Tenant may void the eviction by paying the full amount owing ($9,667.95 if paid by Dec 31, 2025) before the order becomes enforceable. Eviction was postponed to January 31, 2026, due to the Tenant's age and financial circumstances.
