What happened

The Landlord applied to terminate the tenancy based on non-payment of rent and persistent late payment. The LTB found the N4 notice for non-payment defective because it stated an incorrect and misleading amount of arrears. However, the LTB upheld the L2 application for persistent late payment, noting the Tenant paid late in 9 out of 12 months. The Tenant admitted to the arrears but requested relief from eviction due to potential homelessness and current unemployment.

The ruling

The tenancy is terminated effective November 30, 2025, due to persistent late payment of rent. The Landlord's application for non-payment was dismissed regarding termination but granted for the collection of arrears. The Tenant is ordered to pay $4,543.51 by November 30, 2025, plus daily compensation of $18.44 from October 15, 2025, until vacating. The eviction is postponed until November 30, 2025, to allow the Tenant time to relocate.
