What happened

The Landlord applied for an order to terminate the tenancy and evict the Tenant due to non-payment of rent. The Tenant attended the hearing and requested relief from eviction in the form of a payment plan, noting he had recently started a new job. While the arrears were relatively low and the Tenant had made recent payments, the Member declined to alter the fundamental rent due date but granted a postponement of the eviction date to allow the Tenant time to void the order.

The ruling

The tenancy is terminated effective December 31, 2025, unless the Tenant voids the order. To void the order by November 30, 2025, the Tenant must pay $3,199.88. If paying by December 31, 2025, the amount is $4,653.68. If the Tenant does not void the order and moves out, he owes the Landlord $114.51 plus daily compensation of $47.80 from October 28, 2025, until he vacates.
