What happened
The Landlord applied for eviction after the Tenant gave notice to terminate the tenancy but failed to vacate the unit. An initial order was issued without a hearing, which the Tenant moved to set aside. After failing to attend a subsequent motion hearing, the Tenant requested a review. At the review hearing, the Landlord consented to the review, but the adjudicator ultimately denied the motion to set aside the eviction order, finding that it would be unfair to the Landlord given the Tenant's history of multiple notices and cessation of rent payments.
The ruling
The Tenant's request for review was granted by consent, but the motion to set aside the original eviction order was denied. The stay of the eviction order is lifted effective May 31, 2025, allowing the Landlord to proceed with eviction if the Tenant does not vacate by that date. The original order remains unchanged.
