What happened
The Tenant filed an application alleging the Landlord acted in bad faith when terminating the tenancy for personal use. The Landlord initially claimed he and his family needed the unit because his parents were selling their home. However, the Landlord purchased a different property on November 27, 2023, but failed to inform the Tenant of this change. The Tenant, believing he had to leave, moved his family to Edmonton, Alberta, incurring significant moving and travel costs. The Board found the Landlord acted in bad faith by not updating the Tenant once the unit was no longer required for personal use.
The ruling
The Landlord is ordered to pay the Tenant $10,129.43 by July 29, 2025. This amount covers moving costs from Ontario to Alberta, car shipping, airfare, and the LTB filing fee. The Board found the Landlord acted in bad faith by allowing the Tenant to vacate for 'personal use' after the Landlord had already secured another home and no longer needed the rental unit.
