What happened
Landlord applied for an order to terminate the tenancy and evict Tenant due to non-payment of rent. The Tenant owed $25,300 in rent arrears as of the N4 notice date. The Tenant requested an adjournment to allow his new legal representative more time to prepare, but this was denied. The Tenant disputed the amount owing, claiming entitlement to a rent abatement, but did not raise these issues properly under the Act.
The ruling
The tenancy is terminated unless the Tenant pays $35,086 by June 27, 2023 to void the order. If the Tenant does not pay, they must vacate by June 27, 2023 and pay the Landlord $30,613.40 plus daily compensation of $78.90 from June 6, 2023 until move-out. The Landlord is entitled to file the order with the Sheriff for enforcement if the unit is not vacated.
