What happened
The Landlord applied for an order to terminate the tenancy and evict the Tenants, claiming she required the unit for her own residential occupation. The Tenants contested the application, raising issues regarding the accuracy of the Landlord's certificate of service and the Landlord's good faith intention to occupy the unit, especially given she purchased the property sight unseen.
The ruling
The Landlord's application to terminate the tenancy for personal use was dismissed. The Adjudicator found the Landlord's evidence lacked credibility due to a false certificate of service and improper conduct by the Landlord's interpreter (her son) during the hearing. The Tenants are ordered to return the $1,859.00 compensation previously paid by the Landlord by June 30, 2025.
