What happened

The Landlords filed for an ex-parte eviction order after the Tenants breached a mediated settlement from July 2025. The Tenants had failed to pay agreed arrears and rent, leading to an eviction order issued on August 5, 2025. The Tenants filed a motion to set aside this eviction order, claiming a misunderstanding of the settlement terms and citing personal hardships, including the primary earner working abroad to pay off debts while his family remained in the rental unit.

The ruling

The Tenants' motion to set aside the eviction order was denied. The stay of eviction will be lifted on September 22, 2025. The Member found that the Tenants' failure to adhere to a previous mediated settlement, combined with arrears nearing $20,000, created significant financial prejudice for the Landlords that outweighed the Tenants' request for further delays.
