What happened

The Landlord applied to terminate the tenancy because the Tenant was persistently late in paying rent. Evidence showed the Tenant paid late 14 times in a 14-month period. However, the Tenant showed improvement after the notice was served, paying on time for five consecutive months leading up to the hearing.

The ruling

The tenancy is allowed to continue provided the Tenant pays the October 2025 rent by October 27, 2025, and pays all future rent between November 1, 2025, and October 1, 2026, on or before the 9th day of each month. If the Tenant breaches these conditions, the Landlord may apply for an eviction order without further notice to the Tenant.
