What happened

The Tenant requested a review of an eviction order issued after she breached a payment schedule from a previous conditional order. The Tenant argued that she was unable to attend the original hearing due to being hospitalized. The Landlords consented to the review. The Tenant also claimed she did not owe money because the Landlords owed her compensation for an N12 notice served in 2022, but the Board found the Landlords never proceeded with that application and no compensation was legally ordered or due.

The ruling

The Board granted the Tenant's request for review due to her hospitalization. The previous order was cancelled and replaced. The Tenant is ordered to pay the Landlords $2,940.64, which includes rent arrears for December 2023 and January 2024, plus outstanding arrears from a previous order and the filing fee, adjusted for interest on the last month's rent deposit. As the Tenant has already vacated, no eviction order was necessary.
