What happened
The Tenant filed an application against the Landlords alleging illegal entry, alteration of locks without providing keys, substantial interference with enjoyment, harassment, and interference with vital services. The Landlords filed a cross-application to determine if the Residential Tenancies Act applies to the living arrangement. The ruling
The Landlord and Tenant Board determined that it lacks jurisdiction over the dispute because the living arrangement is exempt from the Residential Tenancies Act, 2006 under Section 5(a). The Board found the arrangement was a short-term, hotel-type business transaction. As a result, the Tenant's application was dismissed.
