What happened
The Landlord applied for an order to terminate the tenancy and evict the Tenants due to their failure to meet a condition specified in a previous LTB order. The Tenants filed a motion to set aside the order, citing the Tenant's consumer proposal filing which resulted in an automatic stay on the Landlord's claim for arrears up to June 14, 2024.
The ruling
The Board set aside the previous order and amended the order to allow the Tenants to void the order by paying the rent owing from June 15, 2024 onwards. If the Tenants do not pay the required amount, the tenancy will be terminated and the Tenants must move out by September 21, 2024. The Tenants were also ordered to pay the Landlord's costs.
