What happened
The Tenant filed applications (T2) alleging that the Landlord entered the rental unit illegally, substantially interfered with his reasonable enjoyment, and harassed or threatened him. The allegations included an attempted illegal entry in January 2022, a delayed move-in date dating back to 2019, and claims that the Landlord made false statements in a previous LTB application. The matter was a review hearing after the Tenant's original applications were dismissed for failure to attend a case conference.
The ruling
The Tenant's application was dismissed in its entirety. The Board found the Tenant did not meet the burden of proof for illegal entry, as no entry occurred. The claim regarding a delayed move-in was dismissed for being filed past the one-year legal deadline. No remedies were granted for the Landlord's statements in a prior application as it had been withdrawn.
