What happened
The Landlord applied to terminate the tenancy and evict the Tenant due to significant rent arrears. The Tenant, who resides in a subsidized unit, admitted to the arrears but explained that health issues and a failure of third-party supporting agencies and the subsidy system led to the debt. The Tenant requested more time to either resolve the funding issues or find a new residence, to which the Landlord did not object.
The ruling
The tenancy is terminated effective January 31, 2026, unless the Tenant voids the order by paying the full arrears. The Tenant is ordered to pay $17,540.61 (representing arrears up to the hearing date minus the deposit and interest). The Tenant may void the order by paying $19,614.40 by November 30, 2025, or increased amounts by subsequent months. Eviction is postponed until January 31, 2026, to allow the Tenant time to secure funds or relocate.
