What happened
The Tenants filed applications (T6 and T2) alleging that the Landlord failed to maintain the rental unit by not addressing a rat infestation and hazardous stairs, and substantially interfered with their reasonable enjoyment following a wall collapse on July 1, 2023, which made the unit uninhabitable. The Tenants vacated the unit on the day of the collapse and did not return.
The ruling
The Tenants' T2 and T6 applications are dismissed. The Board found that the Landlord acted reasonably and met their maintenance obligations in response to complaints about a rat infestation, unsafe stairs, and a wall collapse. The Tenants failed to provide sufficient evidence to support their claims and voluntarily abandoned the tenancy and their belongings.
