What happened
The Landlord applied for termination of tenancy and eviction due to non-payment of rent. The Tenants requested an adjournment to seek legal counsel and attempted to raise maintenance issues under Section 82. The request for adjournment was denied due to lack of prior notice and potential financial prejudice to the Landlord. The Tenants were also barred from raising Section 82 issues as they failed to comply with disclosure rules.
The ruling
The tenancy is terminated effective December 31, 2025, unless the Tenants void the order by paying $12,906.00 by November 30, 2025, or $15,426.00 by December 31, 2025. If the Tenants do not void the order, they must move out by the end of the year and pay the Landlord $8,218.63 plus daily compensation of $82.85 from November 6, 2025.
