What happened
Landlord applied for an order to terminate the tenancy and evict Tenants due to failure to pay rent. The application was filed after serving a valid Notice to End Tenancy Early for Non-payment of Rent (N4 Notice), which the tenants did not void by paying the arrears. The tenants were still in possession of the rental unit at the time of the hearing.
The ruling
The tenancy will be terminated effective June 18, 2023 if the tenants do not pay $24,422 to void the order. If the tenancy is terminated, the tenants are ordered to pay $20,468.40 to the landlord, which includes rent arrears up to the hearing date and the cost of filing the application, minus the rent deposit and interest on the deposit. The tenants must also pay $49.45 per day in compensation for use of the unit starting May 12, 2023 until they move out.
