What happened

The Landlord applied to terminate the tenancy for personal use (N12) following a separation from their spouse. The Landlord requires the unit for their own residential occupation for at least one year. Evidence was provided that compensation was paid to the Tenants as required by the Act. The Tenants did not attend the hearing to contest the application or request relief from eviction.

The ruling

The tenancy is terminated effective December 9, 2025. The Landlord successfully demonstrated a good faith need to occupy the unit due to personal circumstances. The Landlord met the statutory requirement to compensate the Tenants by paying one tenant $750.00 and waiving the other tenant's April 2025 rent of $768.00. The Landlord may enforce the eviction through the Sheriff starting December 10, 2025, if the Tenants do not vacate.
