What happened
The Tenant applied for orders related to the Landlord (the Estate of Branko Vukelic) entering the rental unit illegally, altering the locking system, substantially interfering with the Tenant's reasonable enjoyment, and harassing, obstructing, coercing, threatening or interfering with the Tenant. The Tenant also applied to determine whether the Residential Tenancies Act, 2006 applies.
The ruling
The Board determined that the Residential Tenancies Act, 2006 does not apply to the rental unit, as the Tenant was in a long-term common-law relationship with the owner, Branko Vukelic, and there was no tenancy agreement between the Tenant and the Estate after Branko Vukelic's passing. The Tenant's applications were dismissed.
