What happened

The Tenant applied for a rent abatement and other remedies, alleging that the Landlord failed to meet maintenance obligations regarding persistent water leaks in the bathroom and kitchen. The leaks reportedly started at the beginning of the tenancy in September 2023 and continued until the Tenant vacated in April 2024. A large hole was also left in the bathroom ceiling for approximately six months. The Landlord claimed their actions were delayed by the condominium corporation and weather conditions affecting repairs under Tarion warranty.

The ruling

The Landlord is ordered to pay the Tenant a total of $5,248.00 by November 30, 2025. This amount includes $1,600.00 for the return of the last month's rent deposit, $3,600.00 as a rent abatement for the loss of enjoyment of the unit due to leaks and a ceiling hole, and $48.00 for the application filing fee. The tenancy was officially terminated as of the date the Tenant vacated, April 30, 2024.
