What happened

The Landlords applied for termination of the tenancy and eviction due to non-payment of rent. A complex family dynamic was present, as the Landlords are the parents of Tenant 1. Tenant 1 had vacated the unit prior to the application, while Tenant 2 remained. Tenant 2 argued she was not a tenant as she did not sign a lease or pay rent. The ruling

The tenancy is terminated effective January 15, 2026, due to $11,919.00 in rent arrears and filing costs. The Tenants may void the eviction by paying the total arrears and additional rent by specific deadlines. If they do not vacate by January 15, 2026, the Landlords may enforce the eviction through the Sheriff. The Member exercised discretion under section 83 to postpone the eviction because Tenant 2 is a single mother and victim of domestic violence, and the Landlords were willing to accommodate a short delay for their grandchildren.
