What happened
The Landlord applied for an order to terminate the tenancy and evict the Tenant due to rent arrears. The Tenant attempted to raise maintenance and pest issues at the hearing, but these issues were excluded as the Tenant failed to provide advance notice or a satisfactory explanation for the delay, despite being incarcerated during the period leading up to the hearing.
The ruling
The tenancy is terminated effective January 5, 2026, unless the Tenant voids the order by paying $6,986.00 by December 31, 2025, or $7,836.00 by January 5, 2026. If the order is not voided, the Tenant must pay the Landlord $6,247.80 plus daily compensation of $27.95 from December 5, 2025, until move-out.
