What happened

Tenants applied for an order determining that the Landlord collected or retained money illegally. The Tenants claimed that they had agreed with the Landlord to terminate the tenancy effective June 19, 2022, but the Landlord failed to return the last month's rent deposit for the period of June 20 - June 30, 2022.

The ruling

The Tenants proved their allegations on a balance of probabilities. The Landlord shall pay the Tenants $1,078.70, which includes $1,030.70 for pro-rated last month's rent and $48.00 for the application filing fee. If the Landlord does not pay by the due date, interest will accrue at 7% annually on the outstanding balance.
