What happened
The Tenants filed an application (T6) alleging the Landlord failed to meet maintenance obligations regarding the stairs leading to the front door and the lack of handrails. A City of Barrie Order to Comply was issued in July 2021 because the stairs contravened the Building Code. The Tenants claimed they notified the Landlord shortly after moving in in March 2021, while the Landlord claimed he only knew upon receiving the City order. Repairs were not completed until August 2022.
The ruling
The Landlord is ordered to pay the Tenants $2,830.19 by May 13, 2025. This amount represents a 15% rent abatement for the period from December 12, 2021, to August 15, 2022, due to the Landlord's failure to repair stairs and handrails which were in a state of disrepair and violated building codes.
