What happened
Tenant 2 requested a review of an order for rent arrears, claiming he was not responsible for the debt because he moved out in February 2024 following a separation from Tenant 1. Tenant 2 further argued he was unable to attend the original hearing because he was working as a shuttle driver for a wedding. The Landlord countered that the lease was never severed and the tenants remained jointly and severally liable for the rent.
The ruling
The request for a review is denied. The original order (LTB-L-021056-25) remains in effect. Tenant 2's move-out and separation did not relieve him of financial liability for rent arrears as the lease was never formally severed with the Landlord's consent.
