What happened

The Landlord applied for termination of the tenancy and eviction due to non-payment of rent. As of the hearing date, significant arrears had accumulated. Tenant 1, representing the tenants, proposed a payment plan which the Board found to be unfair to the Landlord as it would take over a year to complete. The tenants raised personal circumstances including a heart condition and the senior refugee status of two occupants as reasons for delay.

The ruling

The tenancy is terminated effective October 2, 2025, unless the tenants void the order by paying the specified arrears and filing fees. If the tenants do not void the order, they must move out by October 2, 2025, and pay the landlord $10,553.48, plus daily compensation of $64.11 from August 28, 2025, until they vacate.
