What happened
The Landlord applied to end the occupancy and evict the Tenants (Co-op Members) due to non-payment of regular monthly housing charges and other related charges. The Tenants remained in possession of the unit at the time of the hearing, despite being served with an N4C notice. While significant arrears were established, the primary issue was whether to grant relief from eviction based on the Tenants' personal and financial circumstances.
The ruling
The LTB ordered the Tenants to pay the Landlord $14,020.00. Relief from eviction was granted on the condition that the Tenants follow a strict payment schedule: $2,333.00 by September 15, 2025; $500.00 monthly from October 2025 to August 2027; and a final payment of $187.00 in September 2027. The Tenants must also pay regular monthly housing charges on time. Failure to meet any payment allows the Landlord to apply for an immediate eviction order without further notice.
