What happened
The Landlord applied for an order to terminate the tenancy and evict the Tenants on the grounds that the Landlord required possession of the rental unit for personal residential occupation for at least one year. The Landlord served an N12 notice of termination but failed to provide the mandatory compensation to the Tenants as required by the Act.
The ruling
The Landlord's application to terminate the tenancy for personal use was dismissed. Despite the Landlord's claim of requiring the unit in good faith, the mandatory legal requirement to pay compensation to the Tenants before the termination date was not met, rendering the eviction request invalid under the Residential Tenancies Act.
