What happened
The Landlords filed an application to evict the Tenants for non-payment of rent. One Tenant attended the hearing, claiming she was only responsible for her 'portion' of the rent and was unaware her co-tenant was not paying. The Tenant's attempt to raise other issues under section 82 was denied due to failure to follow disclosure rules. The Board found that under the joint tenancy, both Tenants were jointly and severally liable for the full rent.
The ruling
The tenancy is terminated unless the Tenants void the order by paying the full amount owing. To void the order, Tenants must pay $18,061.00 by April 30, 2025, or $20,811.00 by May 6, 2025. If the order is not voided, the Tenants must vacate by May 6, 2025, and pay the Landlords $10,353.46 for arrears up to the hearing date, plus $90.41 daily compensation from February 7, 2025, until they move out.
