What happened

The Landlord applied to terminate the tenancy and evict the Tenant for substantial interference with the Landlord's lawful interests due to the non-payment of electricity and water utilities. The Tenant disputed the accuracy of the bills, claiming the metering equipment was faulty or tampered with. Following a third-party electrical inspection which found the equipment functioning correctly, the Landlord requested a conditional order rather than immediate eviction, allowing the Tenant time to clear the arrears and maintain future payments.

The ruling

The tenancy continues subject to conditions. The Tenant must bring the utility account balance to $0.00 by June 30, 2026, and must pay all new utility bills on time until June 30, 2027. If the Tenant breaches these conditions, the Landlord may apply for an ex parte eviction order. The Tenant is also ordered to pay the Landlord $186.00 for the filing fee by July 15, 2025.
