What happened

The Tenant filed a motion to set aside an ex parte eviction order (issued after the Tenant allegedly breached a previous LTB-mediated payment plan). The Landlord claimed the Tenant failed to pay October 2025 rent in full and on time and missed subsequent arrears installments. The Tenant argued he was misled by the Landlord's website regarding the amount owed and that a maintenance worker told him not to pay rent because he was being evicted. The Tenant also cited personal issues related to a storm in Jamaica.

The ruling

The Tenant's motion to set aside the eviction order was denied. The Board found that the Tenant repeatedly breached the conditions of a previous order by making late payments and missing arrears installments. Although the Tenant requested a delay until March 2026, the Board lifted the stay of the eviction order effective January 31, 2026, providing a brief period for the Tenant to find new housing.
