What happened

The Landlord applied to terminate the tenancy and evict the Tenant for non-payment of rent. The Tenant admitted to owing a significant portion of the arrears but claimed to have paid more than the Landlord acknowledged. However, the Tenant failed to provide any documentary evidence to the Landlord or the Board prior to the hearing. The Landlord sought eviction due to financial hardship and mortgage default on the property.

The ruling

The tenancy is terminated effective July 29, 2025, unless the Tenant voids the order by paying $41,163.36 by July 26, 2025 (or $44,763.36 by July 29, 2025). If the Tenant does not void the order and moves out, the Tenant is ordered to pay the Landlord $31,265.50 plus daily compensation of $118.36 from June 6, 2025.
