What happened

The Landlord applied to evict the Tenant for substantial interference and failure to pay utility costs, which was a breach of a previous LTB conditional order. The Tenant had failed to pay water utility bills totaling $1,152.71 and did not rectify the issue after receiving an N5 notice.

The ruling

The tenancy is continued on the condition that the Tenant complies with a payment plan and future obligations. The Tenant must pay the Landlord $1,338.71 (unpaid utilities plus filing fee) in installments from July to December 2025. The Tenant must also pay $12,246.31 in compensation by December 15, 2025. Furthermore, the Tenant must pay all water bills on time for one year. If the Tenant breaches any condition, the Landlord can apply for an eviction order without notice.
