What happened
The Landlord, a corporation, applied for an order to terminate the tenancy and evict the Tenant due to non-payment of rent and additional charges for NSF cheques. The Tenant did not attend the hearing. The Board found the N4 notice was valid and the Tenant had not paid the arrears, which had grown to a significant amount.
The ruling
The tenancy is terminated unless the Tenant pays $29,866.20 by April 26, 2025. If this amount is not paid, the Tenant must vacate the unit by that date and must pay the Landlord $24,583.64, which accounts for arrears up to the hearing date and other fees, less the rent deposit. The Tenant will also owe daily compensation of $96.84 from April 8, 2025, until they move out. The Landlord's request for an expedited eviction was denied.
