What happened
The Landlord applied for termination and eviction based on non-payment of rent, persistent late payments, and substantial interference with rights. The substantial interference claim included smoking issues and failure to pay utility bills. The Tenants were noted to have been late with rent 11 times in 11 months and owed significant arrears exceeding $13,000. The Tenants did not attend the hearing.
The ruling
The LTB terminated the tenancy effective October 27, 2025. The Tenants are ordered to pay the Landlord a total of $14,003.32, which includes rent arrears, unpaid utility expenses, and the application filing fee. Because the eviction was granted on the grounds of persistent late payment and substantial interference, the order is non-voidable by payment of arrears. The Landlord is also granted daily compensation of $39.45 until the Tenants vacate.
