What happened

The Landlord applied to terminate the tenancy because the Tenant substantially interfered with the reasonable enjoyment or lawful rights of the Landlord and other tenants. The issues involved persistent garbage accumulation in the backyard and carport, and a derelict vehicle leaking oil. By-law enforcement from the City of St. Catharines was involved due to non-compliance. The Tenant cited mental health struggles and financial hardship as reasons for the delay in maintaining the property.

The ruling

The tenancy is allowed to continue provided the Tenant complies with specific conditions for 24 months, including keeping the carport and backyard clean and properly disposing of garbage. The Tenant must also permit monthly inspections for 12 months starting February 2026. The Tenant is ordered to pay the Landlord $5,061.12 for compensation and filing costs. If the Tenant breaches the conditions, the Landlord may apply for an ex parte eviction order within 30 days of the breach.
