What happened
The Landlord applied to evict the Tenants for breaching a condition in a previous LTB order from March 17, 2025. The Tenants had failed to pay arrears of $1000.00 by March 21, 2025. An ex-parte eviction order was subsequently issued on April 9, 2025. The Tenants filed a motion to set aside this eviction order, which was heard and ultimately denied.
The ruling
The Tenants' motion to set aside an eviction order is denied. The eviction was ordered after the Tenants breached a previous order by failing to make a required payment towards arrears. The Adjudicator found that despite the Tenants' financial hardships, the significant arrears of over $12,000 made it unfair to the Landlord to continue the tenancy. The stay on the eviction order is lifted, effective June 30, 2025.
