What happened
The Landlord applied for an order to terminate the tenancy and evict the Tenants for non-payment of rent. Tenant 2 argued that Tenant 1 had moved out in April 2025 and should be removed from the proceedings, but the adjudicator denied this, maintaining the joint tenancy. Tenant 2 also disputed the arrears amount, claiming she had made more payments than the Landlord recorded. The Landlord failed to provide a rent ledger, leading the Board to accept the Tenant's calculation of arrears.
The ruling
The LTB ordered the Tenants to pay $821.79 in rent arrears and costs through a 12-month payment schedule. If the Tenants make the scheduled payments and pay future rent on time, the eviction application is stayed. However, if any payment is missed, the Landlord may apply for an ex-parte order to terminate the tenancy and evict the Tenants.
